A county court judgment, entered in default, was made on 8 January 2013 against the operator of the North Pier located in Blackpool. The case—#2QZ48128—Smith v Northern Victorian Pier Ltd., would have been heard at Blackpool County Court, but the company's only director Sue Sedgwick, ignored the Court process.
The Claimant will now petition the Court for an Order to wind-up the company.
On 10 February 2012 the tenant agreed to rent Kiosk 15 on the North Pier. After refurbishing the empty kiosk to a very high standard including the addition of hot/cold running water, a new tile floor, new front/rear counters and bringing the dangerous electrical system up to legal standard—spending more than £3,870 repairing what was an unusable space—the tenant determined that the pier company's agent, Steve Marshall, had misrepresented the financial prospects of the location.
Faced with the prospect of working with the disingenuous operator, the tenant decided to sublet the kiosk to another tenant and Marshall accepted the new tenant but then opted to execute a fresh agreement, without explanation.
Despite having initially agreed to return the tenant's deposit, Marshall later refused to return the money and has ignored all requests since April 2012 for the return of the deposit.
On a related matter, a Petition to wind-up Northern Victorian Pier Limited was presented on 17 September 2012 by Carlsberg UK Limited and was to be heard at Blackpool County Court on 15 November 2012. (Source) However, at the 11th hour, an agreement to pay the outstanding balance owed to Carlsberg was made and Peter Sedgwick's company escaped liquidation.
